General Terms and Conditions (GTC) - "Holiday Home Zum Waldrand"
Landlord: Brigitte Orth-Jordan, Winterbergstr. 80, 66996 Erfweiler1. Arrival / Departure
• Saturday from 4:00 PM until the following Saturday at the latest 11:00 AM. Arrival and departure times also apply to individually agreed weekdays. Departure must take place by 11:00 AM on the day of departure.• Exceeding the departure time by more than 60 minutes will result in the charge of an additional overnight stay.
• Other arrival and departure times can be individually agreed with the landlord.
• If the tenant does not arrive by 10:00 PM on the arrival day, the contract is considered terminated after a period of 48 hours without notification to the landlord. The landlord or their representative may then freely dispose of the property. A (partial) refund of the rent due to early departure is generally not possible.
2. Special Requests and Side Agreements
• are generally possible. They require written confirmation by the landlord.• Smoking is not permitted in the house.
• No pets are allowed.
3. Payment
• The rental contract becomes valid upon receipt of the deposit into the landlord's account. The deposit of 50% of the rental amount is due immediately or within fourteen days upon receipt of the invoice. After the deposit has been made, the remaining amount is due 30 days before the start of the trip.• For bookings less than 28 days before the start of the trip, the full travel price is due immediately.
• If payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is considered as withdrawal and entitles the landlord to re-rent the property.
• Additional costs for energy (water, electricity, gas), parking space, and waste disposal are not charged.
4. Cancellation
• You can cancel the contract at any time. Cancellation must be made in writing. In case of cancellation, you are obliged to compensate for the damage incurred:• From the day of booking confirmation by the landlord up to 30 days before rental start: no compensation.
• After the 30th day before rental start: 100% of the total price.
• If cancellation occurs less than thirty days before rental start, the full travel price must be paid. The date of receipt of your cancellation notice applies. Any already paid amounts will be offset. You may provide a substitute person who enters your contract under the stated conditions, subject to approval by the landlord. A written notification is sufficient.
5. Tenant's Duties
• The tenant is obliged to handle the rented property (holiday home, inventory, and outdoor facilities) with care.• If damages occur to the holiday home and/or its inventory during the rental period, the tenant must report them to the property management immediately. Any defects and damages identified upon arrival must be reported immediately; otherwise, the tenant is liable for these damages.
• A reasonable period must be allowed for the rectification of damages and defects. Claims for complaints not reported immediately on-site are excluded.
• Complaints received only at the end of the stay or after leaving the holiday home are also excluded from compensation.
• In case of service disruptions, the tenant is obliged to do everything reasonable within the framework of their legal obligations to contribute to resolving the disruption and to minimize any damage that may occur.
• On the day of departure, the tenant must remove personal belongings, dispose of household waste in designated containers, and store clean and washed dishes in the kitchen cabinets.
6. Data Protection
• The tenant agrees that necessary personal data related to the contract may be stored, modified, and/or deleted. All personal data will be treated as strictly confidential.7. Liability
• The advertisement was created to the best of our knowledge. No liability is accepted for impacts on the rental property due to force majeure, customary power and water outages, and weather conditions. Likewise, no liability is assumed for unforeseen or unavoidable circumstances such as official orders, sudden construction sites, or disturbances due to natural and local conditions. The landlord is, however, happy to assist in resolving any problems (as far as possible).• The landlord is not liable for the use of provided play and sports equipment.
• The use of the garden is at your own risk. Altering the garden layout is not allowed. Depending on the season, various berries can be harvested in the garden. Currants, gooseberries, and blueberries can be picked and eaten. Please handle the bushes responsibly and do not break branches.
• The tenant's arrival and departure are at their own responsibility and risk. The landlord is not liable for personal belongings in case of theft or fire. The tenant is fully liable for willful damage or destruction.
8. Final Provisions
• Photos and text on the website or in the flyer serve as a realistic description. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture) as long as they are of equal or higher value.• If one or more provisions of these terms and conditions are or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic and legal intent of the contractual parties.
• German law applies. The place of jurisdiction and performance is the residence of the landlord.
